Your privacy is important to BAL Inc (Baliston®). We developed this Privacy Policy to provide you with information on how we process your personal data when you create a Baliston account, interact with our customer support specialists, make a purchase in one of our stores, visit Baliston.com or other Baliston websites, or use Baliston apps that include a link to this Privacy Policy.
This Privacy Policy describes and applies exclusively to personal data or personal information (as defined below) that we collect on or in connection with the Baliston websites products, services, websites, apps, and in texts, emails, and other electronic communications sent by or in connection with Baliston. Except as otherwise provided in this Policy or as required by applicable law, this Policy does not apply to information that is collected by any application, website, or third party other than Baliston, including through any application or content that may access, be linked to, or otherwise be accessible from Baliston. If you visit an application, website, or third party that we mention or link to, be sure to review its privacy policy before providing it with any information, as that privacy policy will apply to your interactions with that application, website, or third party.
"Personal data" or "personal information" is information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Categories of Personal Data Processed by Baliston
Personal data that is processed when you create a Baliston account:
Identifiers, including email address, name, phone number, and other similar identifiers.
When you create a Baliston account, we ask you to provide your email address, name, and password. You can choose to provide only your first name or a nickname instead of your full name if you wish. We may also ask you to provide your mobile phone number.
PURPOSES AND LEGAL GROUNDS:
(a) Baliston processes your email address and password because you use your email address and password to sign into your account. The legal ground for processing your email address and password for this purpose is Baliston 's legitimate interest in protecting the security of your account. The legal ground for processing this information for this purpose is Baliston's legitimate interest in protecting the security of your account.
(b) Baliston also processes your email address for the purpose of sending you important information about your Baliston products, services, apps, or account, such as important safety information or material changes to this Privacy Policy. The name you provide is associated with your account profile and is displayed when you submit comments or other material on a Baliston website or app or engage with other Baliston users. The legal ground for processing your email address and name for these purposes is Baliston’s legitimate interest in providing you important safety or other information about your Baliston products, services, apps, or account or material changes to this Privacy Policy and in providing you an opportunity to engage with other Baliston users.
(c) If you provide your opt-in consent to receiving marketing information from Baliston, Baliston will also process your email address for the purpose of sending you marketing information about Baliston products, services, and apps, as well as newsletters. The legal ground for processing your email address for this purpose is your consent. You may withdraw your consent at any time by changing your preferences in your Baliston account or through the unsubscribe link at the bottom of our marketing emails. The marketing emails you receive from Baliston are based on the preferences you provide in your Baliston account, which you can change at any time, the locale indicated by your Internet Protocol (IP) address, the types of Baliston devices you have added to your Baliston account, and any subscriptions included in your Baliston account. The legal ground for processing this data for this purpose is Baliston’s legitimate interest in reducing the number of marketing emails sent to each particular customer by selecting which customers receive a particular marketing email rather than sending every marketing email to every customer who has consented to receiving marketing emails.
(d) Baliston also processes your email address to associate it with your Baliston account when you interact with our customer support representatives. The legal ground for this processing is our legitimate interest in providing quality customer support.
(e) Baliston also processes your email address to notify customers when they have violated our terms. The legal ground for this processing is our legitimate interest in ensuring a quality experience for all customers and ensuring adherence to our terms.
Personal data that is processed when you sync your Baliston device:
Information about your internet connection, IP address and other unique device identifiers, your activity, and other usage details.
When you sync your Baliston device through Baliston Connect app, we log data about the transmission, such as the IP address used when syncing, the sync time and date, crash/diagnostic logs, geographic location of the device, information about your device, information about the network used to sync (e.g., Wi-Fi or cellular), and device battery level.
PURPOSE AND LEGAL GROUND:
We process this information to help identify and resolve errors or syncing issues. The legal ground for processing this information for this purpose is Baliston’s legitimate interest in resolving errors or syncing issues and providing quality product support.
Personal data that is processed when you use the Baliston app or device:
Biometric data, such as your gait patterns and rhythms.
However, we do not collect any biometric identifying scans from you.
Personal data that is processed when you communicate with Baliston.com:
Identifiers, such as name, address, email address, phone number, and other similar identifiers.
Commercial information, such as product preference information and other information related to your purchases or potential purchases.
When you interact with our customer support representatives by email or telephone, online, or in person, we collect personal data, such as your name, mailing address, phone number, email address, and contact preferences, and information about the Baliston products you own, such as their serial numbers and dates of purchase, and subscriptions you've purchased. We also may create event logs that are useful in diagnosing product or app performance-related issues and capture information relating to the support or service issue. To improve customer service, subject to applicable laws, we may also record and review conversations with customer support representatives and analyze any feedback provided to us through voluntary customer surveys. With your consent, our customer support representatives may sign into your Baliston account, if appropriate, to help troubleshoot and resolve your issue.
PURPOSES AND LEGAL GROUNDS:
We use this information to provide you with customer and product support, to monitor the quality and types of customers and product support we provide to our customers, and to facilitate repairs, returns, or exchanges. The legal ground for processing this information for these purposes is Baliston’s legitimate interest in providing quality product support. The legal ground for signing into your Baliston account, if appropriate, to help troubleshoot and resolve your issue is your consent, which you may withdraw.
Personal data that is processed when you purchase a product, service, or subscription on a Baliston website or app or through customer support:
Identifiers, such as name, address, email address, phone number, date of birth, and other similar identifiers.
Demographic information, such as age, height, weight, gender, and other similar categories.
Commercial information, such as payment information.
If you purchase a product, service, or subscription on a Baliston website or app or through customer support, then Baliston will collect your name, address, date of birth, height, weight, gender, email address, and telephone number. We do not view or store your payment card information, which is handled by third-party service providers.
PURPOSES AND LEGAL GROUNDS:
We collect your name, mailing address, and telephone number so we can process your order and fulfill your purchase. The legal ground for processing your name, mailing address, and telephone number for these purposes is the performance of a contract. We also process your personal data as part of our fraud detection processes. The legal ground for processing your personal data for that purpose is our legitimate interest in protecting Baliston and our customers from attempts to engage in fraudulent transactions.
Sensitive Data
We will not collect or process your sensitive data without your affirmative consent. We obtain this consent separately when you take actions leading to our obtaining the information, for example, when you sync your device to your account or grant us access to your information from another service. You can use the Account Management Center to withdraw your consent at any time, or you may contact us to withdraw your consent. Categories of Recipients of Personal Data
We may disclose personal data that we collect or that you provide from any category identified above as described below.
SERVICE PROVIDERS:
We use cloud services from third parties such as Shopify and SendGrid, a Twilio service, to assist in sending emails. Those services track the activities associated with these emails, such as whether they were opened, whether links in the emails were clicked on, and whether purchases were made following clicks on those links. We use this data to analyze the level of engagement with our emails.
We use third-party service providers to help us better understand the usage and performance of our products, services, websites, and apps. See the "Monitoring and Analytics" section for more information.
We use a third-party service, Shopify and Recharge to collect and process your personal and financial data for payment.
We use a third-party services, DHL and UPS, to allow you to view shipment information and track items purchased from our website or purchased, repaired, or exchanged through customer support.
From time to time, we may disclose personal data to additional third-party service providers to support our business.
Our third-party service providers are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
OTHER DISCLOSURES:
We may process and disclose personal data about you to others: (a) if we have your valid consent to do so; (b) to protect the rights, property, or safety of Baliston, our customers, or otherwise, in circumstances when we believe disclosure is necessary or appropriate; (c) to comply with legal obligations, such as a valid subpoena, court or judicial order, or other valid legal process; (d) to enforce our rights arising from any contracts entered into between you and us, including for billing and collection, or to enforce any of our terms and conditions or policies; or (e) as necessary to pursue available legal remedies or defend legal claims.
We may also transfer your personal data to an affiliate, a subsidiary, or a third party in the event of any actual or proposed reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock, including, without limitation, in connection with any bankruptcy or similar proceeding, provided that any such entity that we transfer personal data to will not be permitted to process your personal data other than as described in this Privacy Policy without providing you notice and, if required by applicable laws, obtaining your consent.
We may use or disclose aggregated information about our users and information that does not identify any individual without restriction.

Monitoring and Analytics
We collect data from users about their usage of our products, services, websites, and apps. The types of analytical information that are collected include the date and time of access to our servers, software or firmware version, the location of the device, language setting, what information and files have been downloaded, user behavior (e.g., features used, frequency of use), device state information, device model, hardware and operating system information, and information relating to how the product, service, website, or app functions. Baliston uses this data to improve the quality, security, and functionality of our products, services, websites, or apps; to develop and market products and features that best serve you and other users; and to help identify and fix stability issues and other usability problems as quickly as possible.
The legal ground for processing this analytical information is our legitimate interest in understanding how our customers interact with our products, services, websites, and apps so we can enhance user experience and functionality.
Here are examples of third-party providers we currently use:
- AWS: AWS is information to help us better understand usage to improve user experience and de-bugging purposes within our platforms.
- Firebase (Crashlytics): Microsoft App Center, formerly known as HockeyApp, a Google service, collects information to help us better understand usage, to improve user experience and to identify and resolve the root causes of crashes or errors.
- Shopify and Amplitude: Both Shopify and Amplitude are used to collect information to help us better understand usage to improve user experience.
- Google Analytics: Google Analytics is used to collect information to help us better understand usage to improve user experience.
- ZCloud: ZCloud is used to collect information to help us understand usage and de-bugging purposes within our platforms.
- Recharge: Recharge is used to collect information to help us with our cookie management.

SOCIAL NETWORKS:
Third-party social networks that provide social networking features (e.g., to allow you to connect to social media, such as Facebook, Instagram, or LinkedIn, to find friends to add as connections or to "Like" a page) in Baliston products, services, websites, or apps may gather information regarding your use of our products, services, websites, or apps. The use of such information by a third party depends on the privacy policy available on that social network’s website, which we encourage you to carefully review. Such third parties may use these methods and this information for their own purposes by relating information about your use of our products, services, websites, or apps with any of your personal information that they may have. We may also obtain analytics information from social networks that help us measure the effectiveness of our content and advertisements on social networks (e.g., impressions and clicks). You should not connect your activities through Baliston products to any social media services without understanding and agreeing to how those services will use your data.
Security
We implement various physical, administrative, and technical safeguards in accordance with industry standards to protect the security of your personal information both online and offline. The safety and security of your information also depends on you. Where you have a password for access, you are responsible for keeping this password confidential. Please do not share your password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to us. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures.
Baliston is a global business. To offer our products, apps, and services, we may need to transfer your personal data to Baliston-owned companies in other countries. Baliston-owned companies are required to follow the privacy practices set forth in this Privacy Policy.
Children
The Baliston products, services, websites, and apps are not directed to nor intended for use by individuals under 16 years old. We do not knowingly collect personal data from individuals under 16 years old, and such individuals are not authorized to use the Baliston products, services, websites, or apps. If you are under 16 years old, please do not provide any personal data to, on, or through the Baliston products, services, websites, or apps. If we learn that we have collected personal data from an individual under 16 years old, we will take steps to delete the information as soon as possible. Privacy Policy Updates
We may update this Privacy Policy from time to time as we add new products, services, and apps, as we improve our current offerings, and as technologies and laws change. You can determine when this Privacy Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes will become effective upon our posting of the revised Privacy Policy.
We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent. This notice will be provided by email or by posting notice of the changes on the Baliston websites and apps that link to this Privacy Policy.
Retention of Personal Data
We will retain your personal data as long as your Baliston account is considered to be active or in accordance with applicable law and regulatory obligations. In addition, see below under “Your Rights” for a description of your right of erasure.
Automated Decision-Making, Including Profiling
Baliston does not make any decisions based on algorithms or other automated processing that significantly affect you.

Your Rights

- Opt-out of certain types of profiling.
- Withdraw consent to collect or process your sensitive data.
To exercise any of these rights, or to delete your Baliston account, please contact us as provided below. We may deny a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect, and we may retain copies of your personal information to the extent required by applicable law.

NOTICE FOR Nevada RESIDENTS OF PRIVACY PRACTICES AND RIGHTS
If you are a Nevada resident, Nevada law provides you with a limited right to opt-out of certain personal information sales. Nevada residents who wish to exercise this sale opt-out right may email us at privacy@baliston.com. Please include "Nevada" in your email subject line and include the following information in your email: (i) your name, (ii) Nevada resident address, and (iii) email address. However, please know we do not currently sell data triggering that statute's opt-out requirements.
